These Terms of Use apply to all who access this website, including but not limited to, Organization Campaigns and Donors.
Use of the Website, however, is not available to persons who cannot form legally binding contracts under the Indian Contract Act, 1872 (the “Contract Act”). Persons who are not competent to contract within the meaning of the Contract Act, i.e., minors, undischarged insolvents, etc. are not eligible to use the Website. Such persons may not register on the Website, transact on it, or otherwise use the Website.
We may revise and update these Terms of Use from time to time at our sole discretion. The Donor hereby agrees to make payments for any Campaign as per the terms and conditions stated herein.
The Donor acknowledges that Sri JanaJagarana Trust is fully responsible for managing and verifying all campaigns listed on the Website or Application. Sri JanaJagarana Trust ensures that donations made through the platform are directly managed and allocated to the intended beneficiaries or causes. The Donor understands and agrees that the Trust exercises full oversight over the use and distribution of the donated funds.
The Donor will receive regular updates about the progress or status of the fundraiser from both the Campaign managed by Sri JanaJagarana Trust, via SMS and email. If the Donor wishes to opt out of receiving such communications, they may log into their Sri JanaJagarana Trust profile and disable notifications for that campaign.
The Website or Application may provide Donors with certain information about the Campaign and its beneficiaries. However, Sri JanaJagarana Trust manages all content, ensuring that the information provided is aligned with the purpose of the campaign. The Trust ensures the authenticity and accuracy of each campaign, but the Donor is encouraged to ask questions directly to Sri JanaJagarana Trust for further clarification if needed.
Sri JanaJagarana Trust guarantees that all donations will be used strictly for the purposes stated in each campaign. The Trust is responsible for ensuring the funds are properly utilized and that each campaign meets its intended goals. In the event of a misrepresentation or false information, the Trust will take appropriate measures to address any discrepancies and ensure the integrity of its campaigns.
The Donor understands that Sri JanaJagarana Trust assumes full accountability for tracking and ensuring the proper utilization of donated funds. Donors are welcome to contact Sri JanaJagarana Trust directly to obtain updates or additional information about how their donations are being used. The Trust is committed to full transparency and will provide any requested details regarding the campaign.
In cases where a campaign is prematurely terminated for any reason, such as the recovery or passing of a beneficiary, Sri JanaJagarana Trust reserves the right to redirect any unutilized donations to another active campaign managed by the Trust. The Trust will attempt to reallocate these funds within 45 days. If Sri JanaJagarana Trust is unable to redeploy the contributions within this time frame, the full amount donated will be refunded to the Donor’s account, and the Donor will be notified accordingly.
Donors authorize Sri JanaJagarana Trust and its payment service providers to collect, process, and remit funds through standard banking channels. Sri JanaJagarana Trust is responsible for overseeing the entire donation process and ensuring that all financial transactions comply with applicable laws and regulations.
Sri JanaJagarana Trust reserves the right to delay or refuse to process payments for any reason, including questionable transactions or suspicious activities. The Trust may also terminate or suspend campaigns if there is suspicion of fraudulent behavior or any violation of laws or policies. The Trust is committed to maintaining the integrity of all campaigns and donations and will take appropriate actions if necessary.
Donations made and transactions performed through our Website are governed by the terms set forth herein and elsewhere in these Terms of Use.
Donors may make contributions towards any Campaign on the Website provided such donation complies with Indian law and applicable laws in the jurisdiction of the Donor.
Upon registration, Donors obtain access to certain information about Organization Campaigns and beneficiaries of Campaigns, including means of direct communication. While Sri JanaJagarana Trust endeavors to pre-screen and qualify Campaigns after an involved exercise, such screening or qualification is not error-free, exhaustive, or warranted by us. Moreover, it is not a substitute for Donors’ independent investigations after Donors have obtained communication access to the Organization’s Campaigns. The Website allows Donors to ask Organization Campaigns questions concerning the Campaign and otherwise test the soundness of any Campaign. By donating through the Website, each Donor hereby represents and warrants that such Donor has conducted the due diligence that such Donor deems appropriate under the circumstances and does not rely on Sri JanaJagarana Trust or its affiliates for the accuracy, completeness, or adequacy of the information supplied on the Website. Moreover, Donors should note that neither Sri JanaJagarana Trust nor any of its affiliates or employees represent or warrant that Organization Campaigns or beneficiaries of Campaigns shall use donated funds in the manner and for the purpose represented by them. Sri JanaJagarana Trust is not a party to any Campaign. Questions concerning the use or utilization of funds are to be directed solely to the Organization Campaigns and beneficiaries of Campaigns, not Sri JanaJagarana Trust or its affiliates or employees.
Notwithstanding the foregoing and solely to facilitate communication, the Donor may be sent from time to time updates about the progress/status of any Campaign and hereby irrevocably consents to receive such communications. In case a Donor or other User wishes to opt out of such communications, such User must log in to their Sri JanaJagarana Trust profile and disable communications for that specific campaign. Donations from outside India must comply with the provisions of India’s Foreign Contribution Regulation Act, 2010, as amended. Under that Act, contributions cannot be made for the benefit of candidates for election; correspondents, columnists, cartoonists, editors, owners, printers or publishers of registered newspapers; judges, government servants, or employees of any corporation or any other body controlled or owned by the government; members of any legislature; political parties or their office bearers; organizations of political nature, as the same may be specified by the Central Government; associations or companies engaged in the production or broadcast of audio news, audio-visual news, or current affairs programs through any electronic mode or any other mode of mass communication; or correspondents or columnists, cartoonists, editors, or owners of associations or companies referred to above. All donations shall be received through the Website from Donors using, in the case of donations outside India, credit and debit cards through PayPal, Razor Pay, Pay U, or any payment platform, and in the case of donations within India, credit cards, debit cards, Real Time Gross Settlement (RTGS), National Electronics Fund Transfer (NEFT), net banking, Unique Payment Interfaces (UPI) and Quick Response (QR) Codes issued by banking and other financial institutions regulated under applicable Laws and deposited in a nodal account maintained with a bank in India. By using the Website, each Donor hereby signifies its understanding, acceptance, and agreement that Sri JanaJagarana Trust is not engaged in providing banking or financial services; instead, all remittances to the Beneficiary of Campaigns shall be made solely through established banking and other clearance and settlement systems regulated under applicable laws. Donor hereby authorizes Sri JanaJagarana Trust, and their respective service providers to collect, process, facilitate, and remit funds through governmentally established banking, clearance, and settlement systems.
There might occur circumstances where a banking or other financial institution might decline, withhold, or delay the processing of donations or remittances, require Sri JanaJagarana Trust or Organization Campaigns to provide additional information, or institute additional safeguards and checks and balances, or take such other action as deemed appropriate in compliance with applicable law. Users, including Donors, hereby covenant to assist Sri JanaJagarana Trust with any compliance obligations and fully cooperate with it in resolving any questions such banking financial institutions or governmental authorities might have.
Sri JanaJagarana Trust reserves the right to refuse to process donations by any Donor, including any questionable transactions. This includes, without limitation, suspected collusion between the Donor and Organization Campaigns to bring about false impressions, mislead other Users, breach/violate any law, further any charges imposed by issuing banks, or generally breach any governmental policies or laws. Where Sri JanaJagarana Trust suspects or has reasonable cause to doubt the credibility of the Donor and/or Organization Campaigns, Sri JanaJagarana Trust may return donations.
Sri JanaJagarana Trust may delay notifying payment/transaction confirmations if Sri JanaJagarana Trust suspects any transaction is suspicious. In addition, Sri JanaJagarana Trust may hold back funds raised and subsequently inform law enforcement officials (instead of refunding the same to the Donor) if it deems in its sole discretion to be appropriate or expedient. Sri JanaJagarana Trust reserves the right to reverse donations at its sole discretion, including in the event of a violation of these Terms of Use. No interest or other charges shall be due or payable on such reversals. Donor acknowledges that Sri JanaJagarana Trust will not be liable for any damages, interests, or claims resulting from not processing such transactions/funds/donations or from any delay in processing transactions/funds/donations.
These Terms of Use shall be governed by and construed in accordance with the laws of India. Jurisdiction shall be exclusively in Mysuru. The campaigns hosted by Sri JanaJagarana Trust are based in India. Access from other countries is on the understanding that all transactions are between the Campaigner and the Donor/Contributor. Sri JanaJagarana Trust does not control or bear liability for any campaigns listed on the Website or Application where money is transacted using the payment facility.
You acknowledge, understand, and agree that the payment facility provided by Sri JanaJagarana Trust is neither a banking nor a financial service. It is merely a facilitator for providing an electronic, automated online payment, receiving payment, collection, and remittance facility for transactions on the Website or Application. These transactions use existing authorized banking infrastructure, card payment gateway networks, and settlement service providers. By providing this payment facility, Sri JanaJagarana Trust is neither acting as a trustee nor in a fiduciary capacity with respect to the transaction or its price.
By availing of the payment facilities on the Website or Application, you acknowledge that these transactions may create a direct contractual relationship between you and the payment service provider. Sri JanaJagarana Trust shall not be a party to such arrangements.
Sri JanaJagarana Trust reserves the right to refuse processing transactions for Donors or Contributors with a prior history of questionable transactions. This includes but is not limited to collusion between the Donor and Campaigner to mislead other Users or any breach of law, policy, or bank-imposed charges.
Sri JanaJagarana Trust may delay notifying the payment or transaction confirmation to the Campaigner if the transaction is deemed suspicious. In such cases, Sri JanaJagarana Trust may hold the transaction amount and notify law enforcement officials, instead of refunding the Donor, if it suspects any form of illegal activity involving the Donor, Contributor, or Campaigner.
Donors and Contributors acknowledge that Sri JanaJagarana Trust will not be liable for any damages, interests, or claims resulting from not processing or delaying a transaction beyond its control.
The Sri JanaJagarana Trust website may contain Working Papers or discussion drafts of Sri JanaJagarana Trust Policy Papers. Comments and responses are welcome, but these should in all cases be addressed directly to Sri JanaJagarana Trust and not uploaded to the Sri JanaJagarana Trust Website. These documents are provided by Sri JanaJagarana Trust as a contribution to discussion on important issues affecting children and families, and to assist Sri JanaJagarana Trust by broadening and deepening the range of the consultations engaged in by the Organization. Donors/Contributors agree to comply with all applicable laws, including but not limited to the Foreign Exchange Management Act, 1999, Information Technology Act, 2000, Prevention of Money Laundering Act, 2002, Foreign Contribution Regulation Act, 2010, and Income Tax Act, 1961, while using the Website or Application.
Donor’s/Contributor’s Arrangement with Issuing Bank
All valid credit/debit cards and other payment instruments are processed using third-party card payment gateways or appropriate payment systems. These transactions are governed by the terms and conditions agreed upon between the Donor/Contributor and the respective issuing bank or payment instrument issuing company.
Donors contributing through Sri JanaJagarana Trust’s Social Impact Plans (SIP) consent to monthly deductions from the specified credit/debit card or payment instrument used for the initial contribution. For more information about this facility, click here.
All online bank transfers from valid bank accounts are processed using the payment gateway provided by the respective issuing bank. These online bank transfers are governed by the terms and conditions agreed upon between the Donor/Contributor and the respective issuing bank.
Without limiting other remedies, we may limit your activity, remove your information, or temporarily/indefinitely suspend or terminate your access to the Website or Application if:
You breach the Terms of Use, Privacy Policy, or any other policies;
We are unable to verify or authenticate any information you provide; or
Your actions are believed to cause potential legal liability for you, other Users, or us.
We may, at our discretion, reinstate suspended Users. However, a User that has been suspended or blocked may not attempt to re-register or use the Website or Application in any manner until reinstated by us. Additionally, if you breach these Terms or the Privacy Policy, we reserve the right to recover any amounts due and initiate legal action, including referring you to the appropriate authorities for criminal or other proceedings.
Sri JanaJagarana Trust (as the Campaigner) shall indemnify and hold harmless Sri JanaJagarana Trust and its owners, licensees, affiliates, subsidiaries, group companies, and their respective officers, directors, agents, and employees (the “Indemnified Parties”) against all claims, actions, penalties, prosecutions, disputes, costs, and expenses (including reasonable attorney’s fees) arising from any default, breach, or negligent act by Sri JanaJagarana Trust (or its beneficiaries) of the terms, conditions, laws, regulations, or third-party rights, as described herein or in individual agreements executed with Sri JanaJagarana Trust.
Donors/Contributors agree to indemnify and hold harmless Sri JanaJagarana Trust and its affiliates, officers, employees, directors, and agents from any and all claims, losses, damages, expenses (including attorney’s fees), and injuries (including death) arising from or related to:
Your use of the Services;
Any donation or loan;
Any Campaign or User Content;
Your violation of these Terms of Use;
Your violation of any third-party rights.
You further agree to indemnify and hold Sri JanaJagarana Trust and its affiliates, directors, employees, and agents harmless from any liabilities or claims arising from:
(i) Omission or misuse, abuse, or theft of any funds raised by Sri JanaJagarana Trust or its beneficiaries for purposes other than those stated;
(ii) Lack of necessary regulatory approvals for receiving funds or conducting activities related to the Campaign;
(iii) Misstatements or omissions of material facts in documents furnished by Sri JanaJagarana Trust or its beneficiaries;
(iv) Any breach of applicable law by Sri JanaJagarana Trust or its beneficiaries, including non-payment of taxes; or
(v) Any third-party claims resulting from Campaign termination, suspension, or refunds.
These indemnities shall survive beyond the expiration of the Terms of Use.
The User acknowledges that Sri JanaJagarana Trust is the entity managing and operating the platform for its own campaigns and causes. As such, Sri JanaJagarana Trust is solely responsible for the content and performance of the campaigns it manages. Sri JanaJagarana Trust shall not be held responsible for any misinterpretations, inaccuracies, or any incorrect social shares or representations of the information related to its campaigns or causes by third parties.
The User shall be entitled to avail the services of Sri JanaJagarana Trust via its Website or Application, subject to these Terms of Use and any other document, agreement, or writing executed or entered into by Sri JanaJagarana Trust and the User individually. Sri JanaJagarana Trust reserves the right to modify these Terms of Use at its discretion, and the User shall be bound by any such modifications at all times.
Under no circumstances will Sri JanaJagarana Trust be liable for any content or materials from any users or third parties, including but not limited to errors or omissions in any content, or for any loss or damage resulting from the use of such content. Sri JanaJagarana Trust does not pre-screen content but reserves the right (but not the obligation) to refuse or remove any content that violates these Terms of Use or is deemed objectionable in its sole discretion.
With respect to the content, photos, images, trademarks, logos, brands, or other materials you upload or post through the Services or share with other users or recipients (collectively, “User Content”), you represent and warrant that you own all rights or have all necessary rights and consents to fully exploit such User Content, including all copyrights, trademark rights, and rights of publicity or privacy. By uploading any User Content, you grant Sri JanaJagarana Trust and its affiliated companies a nonexclusive, worldwide, royalty-free, fully paid-up, transferable, sublicensable, perpetual, irrevocable license to copy, display, upload, perform, distribute, store, modify, and otherwise use your User Content in connection with the operation of the Services or its promotion.
If any User Content contains your name, image, or likeness, you release and hold harmless Sri JanaJagarana Trust and its contractors and employees from all claims related to privacy, publicity, or libel. You waive any right to inspect or approve any intermediary or final versions of the use of your User Content. If any person other than you appears in your User Content, you represent that you have secured all necessary licenses, waivers, and releases from such persons.
You acknowledge that your participation in the Services and submission of User Content is voluntary and that you will not receive financial compensation for the use of such content. The sole consideration is the opportunity to use the Services.
You agree that any feedback or suggestions about the Services (“Submissions”) are non-confidential, and Sri JanaJagarana Trust is entitled to unrestricted use and dissemination of these Submissions for any purpose without acknowledgment or compensation.
a) Use of the Website or Application is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents, etc., are not eligible to use the Website or Application. If you are a minor i.e. under the age of 18 years, you shall not register as a member of Sri JanaJagarana Trust and shall not transact or use the Website or Application. As a minor, if you wish to use or transact on the Website or Application, such use or transaction may be made by your legal guardian, parents, or through an organization / NGO competent to contract on the Website or Application. Sri JanaJagarana Trust reserves the right to terminate your membership and/or refuse to provide you with access to the Website or Application if it is brought to Sri JanaJagarana Trust’s notice or if it is discovered that you are under the age of 18 years.
b) Organizational Campaigner / Legal Person’s Registration: If you are registering as an Organization / Entity or generally as a Legal Person, not being a natural person, you represent that you are duly authorized by the Organization / Entity Management to accept these Terms of Use and you have the authority to bind the Organization / Entity to these Terms of Use.
The Sri JanaJagarana Trust website may contain bulletin boards, chat rooms, access to mailing lists, or other message or communication facilities. The user agrees, when taking advantage of such facilities, not to do any of the following: (a) defame, abuse, harass, stalk, threaten or otherwise violate the legal, moral, or human rights of others (such as rights of privacy and publicity); (b) publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information; (c) upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy) unless the user owns or controls the rights thereto or has received all necessary consents; (d) upload or attach files that contain viruses, corrupted files, or any other similar software or Software programme that may damage the operation of another’s computer; (e) delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded; (f) falsify the origin or source of software or other material contained in a file that is uploaded; (g) advertise or offer to sell any goods or services, or conduct or forward surveys, contests, or chain letters; or (h) download any file posted by another user that the user knows, or reasonably should know, cannot be legally distributed in such manner. Sri JanaJagarana Trust reserves the absolute right to delete any material posted to the Sri JanaJagarana Trust website without notice to the user.
Sri JanaJagarana Trust adheres to the Anti-Money Laundering (AML) guidelines established by the Reserve Bank of India, as outlined in notification RBI/DBR/2015-16/18, Master Direction DBR.AML.BC. No.81/14.01.001/2015-16, and updated from time to time. These guidelines include, but are not limited to, the following key requirements:
Identity Verification: All recipients (campaign organizers) associated with Sri JanaJagarana Trust must verify their identity in accordance with Know Your Customer (KYC) guidelines. This includes:
Verification of the registered mobile number via a One Time Password (OTP).
Submission of one of the identification documents recognized by the Reserve Bank of India, such as Permanent Account Number (PAN), Aadhar Card Number, or Passport. A list of acceptable documents will be updated periodically on Sri JanaJagarana Trust’s website.
Withdrawal Requirements: Verification of identity is mandatory for withdrawing funds from Sri JanaJagarana Trust. Verification may be requested at any time during a campaign. Failure to comply may result in the cancellation of a fundraising campaign, with funds being returned to donors if necessary.
Location and Campaign Validity: The location listed on your Campaign page must match your legal residence as submitted to Sri JanaJagarana Trust when requesting a withdrawal. Campaigners are not permitted to create multiple campaigns without fulfilling the obligations of previous campaigns. Failure to meet campaign obligations may lead to the removal of the campaign(s) and potential reimbursement claims, including through third-party collection services. Only authorized campaigners are allowed to collect campaign funds.
Tax Responsibilities: Campaigners are responsible for any taxes on contributions and must not use false email addresses to self-fund or contribute to their campaigns, as this violates Sri JanaJagarana Trust’s policies and Terms of Use. Sri JanaJagarana Trust may request personal account numbers or tax identification numbers (PAN) from campaigners and beneficiaries to report taxable income to relevant tax authorities. Donors wishing to avail of tax benefits under Section 80G of the Income Tax Act will also be required to provide their PAN.
Payment Channels: Contributions on Sri JanaJagarana Trust.org can only be made through verified payment channels, including credit or debit cards, net banking, UPI ID, or cash (up to limits allowed by the RBI). For cash payments exceeding INR 24,999, contributors must provide their Permanent Account Number (PAN).
Foreign Exchange Compliance: Recipients (campaign organizers) must comply with the Foreign Exchange Management Act, 1999, and the Foreign Contribution Regulation Act (FCRA) concerning foreign funds. Sri JanaJagarana Trust does not verify the recipient’s compliance with applicable foreign exchange laws. It is the responsibility of the recipient to obtain necessary approvals and ensure compliance before withdrawing foreign funds. By requesting to withdraw foreign funds, recipients acknowledge that they have completed all necessary documentation.
Policy Updates: AML policies will be updated periodically at the sole discretion of Sri JanaJagarana Trust.
You agree that Sri JanaJagarana Trust, at its sole discretion, may suspend or terminate your account (or any part thereof) or your use of the Services, and may remove and discard any content within the Services, for any reason, including, but not limited to, lack of use or if Sri JanaJagarana Trust believes that you have violated or acted inconsistently with the letter or spirit of these Terms of Use. Any suspected fraudulent, abusive, or illegal activity that may warrant termination of your use of the Services may be referred to appropriate law enforcement authorities. Sri JanaJagarana Trust may also, at its sole discretion and at any time, discontinue providing the Services or any part thereof, with or without notice. You agree that any termination of your access to the Services under any provision of these Terms of Use may be effected without prior notice. You acknowledge and agree that Sri JanaJagarana Trust may immediately deactivate or delete your account and all related information and files in your account, and/or bar any further access to such files or the Services. Further, you agree that Sri JanaJagarana Trust will not be liable to you or any third party for any termination of your access to the Services.
You agree that you are solely responsible for your interactions with any other users in connection with the Services. Sri JanaJagarana Trust will have no liability or responsibility with respect to such interactions. Sri JanaJagarana Trust reserves the right but has no obligation, to become involved in any way with disputes between you and any other user of the Services.
These Terms of Use constitute the entire agreement between you and Sri JanaJagarana Trust and govern your use of the Services, superseding any prior agreements between you and Sri JanaJagarana Trust regarding the Services.
